The Internal Security Act 1960 (ISA) is a preventive detention law in force in Malaysia. Preventive detention was inherited by Malaysia as part of the colonial baggage that the British left behind. Malaysia is one of the few countries in the world whose Constitution allows for preventive detention during peacetime without safeguards that elsewhere are understood to be basic requirements for protecting fundamental human rights. Article 149 of the Malaysian Constitution under which a person may be detained is characterised by subjective language. Such terms as ‘substantial body’, ‘substantial number’, ‘cause to fear’, ‘excite disaffection’, ‘promote feelings of ill-will and hostility’, all embody wide areas of discretionary interpretation. Preventive detention first became a feature of the then Malaya in 1948 primarily to combat the armed insurgency of the Malaysian Communist Party. The Emergency Regulations Ordinance 1948 was made, following the proclamation of an emergency, by the British High Commissioner Sir Edward Gent. It allowed the detention of persons for any period not exceeding one year. The Emergency Regulations Ordinance 1948 was primarily made to counter acts of violence and, conceivably, preventive detention was meant to be temporary in application. The emergency ended in 1960 and with it ended the powers contained in the Emergency Regulations Ordinance 1948 as it was repealed. The power of preventive detention was however not relinquished and in fact became an embedded feature of Malaysian law. In 1960 itself, the government passed the Internal Security Act under Article 149 of the Malaysian Constitution. It permitted the detention, at the discretion of the Home Minister, without charge or trial of any person in respect of whom the Home Minister was satisfied that such detention was necessary to prevent him or her from acting in any manner prejudicial to national security or to the maintenance of essential services or to the economic life in Malaysia. The ISA is one of the most controversial Acts enacted under Article 149 of the Malaysian Constitution. Section 8(1) of the ISA provides that ‘(i)f the minister is satisfied that the detention of any person is necessary …’ then s/he may issue an order for his/her detention. The three grounds given in Section 8(1) upon which the order may be based is where a person has acted in any manner prejudicial to the:

a) Security of Malaysia or part thereof; b) Maintenance of essential services; and, c) Economic life.

The power to detain seems to be restricted by section 8(1) to a period not exceeding two years but the restriction is really illusionary because, by virtue of section 8(7), the duration of the detention order may be extended for a further period not exceeding two years and thereafter for further periods not exceeding two years at a time. The extension to the detention order may be made on the same ground as those on which the original order was based or on different grounds. In delivering the judgment of the Court, Steve L.K. Shim CJ (Sabah & Sarawak) in Kerajaan Malaysia & 2 Ors. v Nasharuddin bin Nasir (2003) 6 AMR 497 at page 506, has accepted that under section 8 of the ISA the Minister has been conferred powers of preventive detention that ‘can be said to be draconian in nature’ but nevertheless valid under the Malaysian Constitution. In addition preventive detention is also now allowed by the Dangerous Drugs (Special Preventive Measures) Act 1985 and the Emergency (Public Order and Prevention of Crime) Ordinance 1969. The Human Rights Commission of Malaysia (SUHAKAM) has recently recommended that the ISA be repealed and replaced by new comprehensive legislation that, while taking a tough stand on threats to national security (including terrorism), does not violate basic human rights.

Article 151 of the Malaysian Constitution gives to any person detained without trial (under the special powers against subversion) certain administrative rights. By the terms of Article 151 the authority, on whose order a person is detained, shall, as soon as may be, inform the detainee of the grounds of detention and the allegations of fact on which the order is based. The detainee shall also be given an opportunity within three months, of making representations against the order to an Advisory Board . The Advisory Board as the name implies is not a court. Its determinations are also mere recommendations that the government is under no obligation to accept. It may also be handicapped in its deliberations by the discretionary power of the government to withhold facts, the disclosure of which would, in the executive’s opinion be against national interest.

Any person may be detained by the police for up to 60 days without trial for an act which allegedly threatens the security of the country or any part thereof. After 60 days, one may be further detained for a period of two years each, to be approved by the Minister of Home Affairs, thus permitting indefinite detention without trial. In 1989, the powers of the Minister under the legislation was made immune to judicial review by virtue of amendments to the Act, only allowing the courts to examine and review technical matters pertaining to the ISA arrest.

Since 1960 when the Act was enacted, thousands of people including trade unionists, student leaders, labour activists, political activists, religious groups, academicians, NGO activists have been arrested under the ISA. Many political activists in the past have been detained for more than a decade.

The ISA has been consistently used against people who criticise the government and defend human rights. Known as the “white terror“, it has been the most feared and despised, yet convenient tool for the state to suppress opposition and open debate. The Act is an instrument maintained by the ruling government to control public life and civil society.

Warning, this material is only for 21 years old and above. Read on your own descretion. First of all why was there a warning statement is because its crazy to see that we have voters age starting from 15 this years. Kindly refer to www.politickler.com to find this out.

Why do you think its important to vote ? Is it necessary to vote? afterall we know its the same thing that going happen which been happening for the past 50 years. Hell yeah! Its definitely important and every vote counts and each candidate’s fate is dependent on your vote, and our state’s future is dependent on the candidate that we choose. Followed by our country fate which than dependent on the candidate that we choose to lead the nation.

Everytime we grouse over unsatisfied issues like, roads, pricing, fairs, taxes, quotas, govermental unfair decision, trade and services. Whats the point of grumbling over something that we have choosen before ??? wasn’t it our decision 5 years ago ? NOW to avoid all this from happening again….

Tips to Vote

1) Find out the person that standing for election in your area (dont do this only when you are walking to vote on the 8th of March)

2) Compare the achievement made by the candidates thus far (regardless race and religion)

3) Find out the education level for the candidates. This is very important, you do not want to put the future of your state on stake.

4) Find out how was your place 5 years ago and see how is it right now. Are you happy ?

5) Make your decision not under anybody influences but your own decision after studying the candidates status and achievement.

6) You decide the kind of intelectual goverment that you want

7) Last but not lease go and VOTE!


Super Nanny

Finnaly we have a Super Nanny who made it for the 12th election. An 89-year-old grandmother (Maimun Yusuf ) grab the attention for all the prominent politicians after she was officially announced as an independent candidate for the Kuala Terengganu parliamentary seat. 

All that she wants is that to be able to speak up and help the nations. Her main aim is that she wants to right the wrongs and bring down the price of essentials. Lets see if our super nanny could make it. 

Now how many of you all would actually  like this nanny to win and represent the State ?? We had so much of trouble saying that our X PM been long serving the nation and getting old to be there and maintaining it ?  Tun Mahathir resign when he was 76 years old on the 22nd June 2002. Now how old would this Nanny be in the next election ? 94 Yeas Old…  thats awesome mate..   Guys throw in your comments… do you think its necessary and whats wrong with our election committee that allows all this superb work….


Finally the twins arrived

Jelo has finally gave birth to twins after 4 years long awaited period. Jelo got married in 2004 with Marc Anthony. Thats like 5 years ago. But the long awaited period works well when she actually gave birth to twins and this would be her first experince and first kids for her.

Wish you all the best and may this kids grows with blessings. Not like other peoples who cant even care for a kid and dump in a plastic bags. Congrats to you Jelo.. way to go…


Babies in Plastic Shopping Bag!!!!

What on earth this human mind state could have been to pack an angel in a plastic bag and dump it just like that??????

Its really sad to to see all this happening right here in our country. This kind of things never happened during our parents days last time…. where had the true parenting gone ??? Yesterday there was this little baby packed in a Plastic Shopping bag and left in front of a Shopping Complex in Miri, Sarawak.

This baby is just few hours old and the worst part is that the baby still had her umbilical cord attached to her. The people who pass by actually thought that it was kitten packed in the plastic bag until on of them went and opened it up and to their surprise they found a very cute little baby full with bloods….

The police arrive just right after a few minutes and this will be investigated till they get the baby’s mother. Now do you call these people humans ? They are worst than a barbarian. Where ever you are dear mother of the baby, come out and reach your daughter.. she have never made any sin nor hurt you for you to dump her just like that…. trust me taking care of the angel would be more than the pleasure that you to make that baby….

I really wonder, how do people actually have the heart to do this to their own kids ??? Do anyone know the answer for this ?


“TIDAK APA” Attitude

Its not something unsual, but very common things that happen in Malaysia. 2 days ago, I walked in to a bank to do some transaction at the counter. When I walked in I was a little happy because they were only 3 customers at the bank including myself. I walked right to the machine and generate the numbering ticket for myself.

Knowing I am the third person, I rush and started to fill up my  forms as quick as possible. “Thinking its going to be my turn soon to move to the counter” Guess what…. there was 8 counters build with a great design of American style and looks so posh. BUT BUT BUT so many buts… because there were only 1 operating counter. I could only see 1 sad soul taking her own sweet time entertaining the customers.

I had pratically sited there patiently for 20 minutes for my turn. What a service ? I wonder if the CEO of this bank do know that this is how their bank works ? And if he or she know about this,  would the action remain the same as the bank management ? Because they are too rich to care. This is why the “TIDAK APA” attitude occurs…. if a privatised bank works this way, how do you think our Govt Bodies work ?????  Just pouring out my frustation…. do share if you guys do go thru the same situation as mine as well…


Human Rights !!! ???? Handing over a rose not a ????

People have human rights all over the world. Guess what?  people could do a rally for Hindraf in New York, USA and Singapore with no Water Canon, FRU and issues. Well this rally is meant for Malaysian’s Indian Ethnic. They could do it in other countries for us peacefully, but we have no rights to do it in our country itself ?

Its wasn’t handing over a ???? RALLY, it was just a Rose handing over rally. Now whats so hard with that ? A total of 160 people got arrested, even a 11 years old girl got arrested ?  Something just got stuck on your head to arrest a 11 years old girl ??? Oh My GOD, i got million dollars question to ask… but guess what, I cant risk myself to be shooted with water canon with FRU’s right infront of my house… knowing that this people are that brilliant and capable doing such a St#@id things.

It had never been our cultural, throwing, tear gas, water canon and police attacks…. against a peaceful rally… think again, we had so much of rally before…. but nothing had been made so tensed the way how things are right now. Sad but true… I am living in this type of country….


Moo Moo Moo

Guess What happen when you actually leave the town and go for holidays? Caught in action. This happened during the Chinese New Year Festive along Jalan Sentul linking to the Mahameru Highway in Kuala Lumpur.  Oh my! my! this is right in the middle of the town. The best part is that, this picture was taken from 5:00pm to 10:00pm during our normal peak hours bumber to bumber.

Its kinda fun to see these cows mooing around on the road instead of the normal cars, truck and bikes. So whats the morale of the story ? do give your pets some freedom from time to time, or else you have to find a new route to travel. :) Tell me if you have actually gone thru something similar like this. Its nice to know and share your experince. I am sure its quite fun to see all this happening in front of your very own eyes.


Its Valentine… a day to ….

Valentine happens every year on the 14th February and it never misses that date, but how many of us missed that day to celebrate… (a moment to think). Because when love first hits us… the first Valentine will be more than anything to celebrate. This  normally happens on the first love. Well its kinda sad that not everyone gets to celebrate their Valentine with the first love forever. Those who get to have their first love forever, you guys must be luckiest on earth. (not in all cases).

I am sure all of us have got our very own historical and memorable Valentine celebration. No matter how was the last celebration we had, lets make it a good one to celebrate this year. Put all those tears, fights, hard time, bad times and let make a good one and a moment to cherish this Valentine.

And for those who is still single out there, not to worry – cause double is trouble and single is simple and easy dude… so enjoy while you are single … and Im sure if you are still single, there would be a single soul out there waiting for you as well, so dont stop .. and keep out looking…. for diamonds and not found on the street.. it is made deep down in the earth, about 180km below the surface, where high temperatures and pressures exist naturally. So nothing comes easy… and things that comes easy does not stay forever.


It only takes a dollar or 10 to save the Angel

Hi all, this is very sad and unfortunately this kind of sickness find the poors as victims. This little baby Velerie Ann is suffering from “cyanotic heart disease” – low oxygen levels in the blood and causes the lips, fingers, and toes to look blue. 

The Father Jonathan Pillai had emptied his life savings which was about RM 23,000 thousand for the baby’s medical treatment thus far. Well, now that the major operation has to be taken place he has gone Zero in savings and hoping how Malaysian could help him. He need RM 481,000 in total for the 3 surgeries to be done. Only this would give him a 70% chance to save the little baby’s life.

As proud generous Malaysian, I am sure we can do more than RM481,000 if each and everyone of us contribute just one day meal of ours to save a great baby’s life. For those Christian’s out there this is Lent season, a good time to care and contribute.
